CORE RESPONSIBILITIES OF OSMV
The OSMV is dedicated to establishing and sustaining safety standards across the vaporized nicotine industry by enforcing RA 11900. Its primary roles include implementing vape regulation policies, setting internationally recognized product standards, coordinating cross-agency collaborations, and enforcing compliance to ensure consumer protection. Moreover, the OSMV fortifies its efforts in routine inspections, online and physical retail checks and tracking to monitor adherence to regulation protocols.
The OSMV ensures full compliance with Republic Act No. 11900 or the Vaporized Nicotine and Non-Nicotine Products Act, focusing on fiscal marking requirements, product standards and age restrictions. To reduce the prevalence of illicit vape trade, the OSMV works collaboratively with Bureau of Internal Revenue (BIR), Bureau of Customs (BOC), Food and Drug Administration (FDA), and Department of Health (DOH).
AUTHORITY AND JURISDICTION
Exclusive DTI Jurisdiction
- The DTI holds exclusive authority over all issues, requirements, and regulations concerning Vaporized Nicotine and Non-Nicotine Products, their devices, and Novel Tobacco Products as outlined in this Act.
Floor Price Regulation
- The BIR is responsible for setting a minimum or “floor” price for Vaporized Nicotine, Non-Nicotine, and Novel Tobacco Products.
- This floor price will consider the total excise tax, value-added tax, and reasonable production costs to ensure fair pricing.
