To ensure consumer safety, the Department of Trade and Industry (DTI), through the E-Commerce Bureau (ECB), reminds the public and stakeholders that selling or advertising regulated products online, particularly on e-marketplaces and digital platforms, is prohibited without the required permits and licenses.

Sections 21 (e) and 22 (b) of Republic Act No. 11967 (RA11967) or the Internet Transactions Act of 2023 (ITA) obliges e-marketplaces and other digital platforms to prohibit the sale and advertisement of regulated products on their platforms.

The sale and advertisement of these products are only allowed if e-retailers or online merchants have obtained the proper permits and licenses from relevant government agencies. Failure to comply will result in legal liabilities, administrative fines and penalties.

A list of regulated and prohibited products with their rules is available through the attached document to help e-marketplaces comply and inform the public. For inquiries about the ITA, its Implementing Rules and Regulations (IRR), and related issuances, contact the DTI ECB via email at [email protected] or call (+632) 7791-3282. ♦
